Any action to enforce the decision of an arbitrator pursuant to Section 26 shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and each user irrevocably submits to the jurisdiction of such courts.

Judgment upon the arbitration award may be entered in any court having jurisdiction thereof.

To the fullest extent permitted by applicable law, all disputes shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding. The arbitrator shall have no authority to consolidate claims or preside over any class, collective, representative, or private attorney general action except where such waiver is prohibited by applicable law.

Notwithstanding the foregoing, Meta may seek temporary, preliminary, or permanent injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property, confidential information, trade secrets, or Website security without first submitting such claims to arbitration.

Any cause of action or claim you may have arising out of or relating to these Terms or the Website must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.

To the fullest extent permitted by applicable law, each Party knowingly and voluntarily waives any right to a trial by jury in any action arising out of or relating to these Terms, the Website, the Privacy Policy, the Cookie Policy, or any dispute concerning the Website.

31. Waiver and Severability

No waiver by Meta of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Meta to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is determined to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of these Terms shall continue in full force and effect.
